摘　　要： 法权是法定之权,包括权力和权利。高等教育领域中权力和权利的分配应该由法律来完成,并通过契约章程进行分权与问责。明确大学的法律地位是现代大学治理的前提,大学各类法权边界的确定是法律规制的起点。现代大学要实现良法善治,就要明确大学与政府、市场等外部法权主体之间的法权边界,也要明确大学与学院、学术与行政、党委与校长,学校与师生等内部法权主体之间的法权边界,并在此基础上进行合理的法权分工和定位。 The legal force is the legal power and right.The distribution of power and right in the field of higher education should be done by law,and the legal force be disposed by way of the Charter.Clearing the legal status of university is the premise of the modern university governance,and the university boundary of all kinds is the starting point of legal regulation.The modern university's'good law and good governance'require the clear external legal force boundary between the university,the government and market subject,and the clear internal legal force boundary between these subjects of the university academic and administrative departments,such as the Party Committee and the principal,the university and the teachers,the university and the students,based on the reasonable power division and right positioning.
