摘　　要： 渔业资源为公有之物的观念导致渔业资源公地悲剧现象。源自古罗马私法上的公共信托理论为英美渔业法制度所吸收并通过司法判例的形式使之获得极大的发展,业已演进为英美现代渔业管理法的重要理论。此理论对渔业资源管理的适用性已为实践所证明。我国应当借鉴英美的公共信托理论并使之转化为实证法条款,以此完善我国的渔业管理制度。 The conception that fishery resources should be considered as public goods has been a cause of Tragedy of Commons of fishery.The Public Trust Doctrine originated in ancient Roman private law and borrowed by Anglo-us fishery act and greatly developed through judicial cases had been a significant theory for modern fishery management system.The applicability of this doctrine to fishery management has been proved by practice.We should borrow from Anglo-us fishery Public Trust Doctrine and absorbed it into our positive law,which will make our fishery law perfect.
