摘　　要： 相对于民事诉讼中"谁主张、谁举证"的证明责任分配规则,行政诉讼中的证明责任倒置是一项公认的基本原则。但具体的规则设置并不等同于原则性规定,必须要考虑不同的行政行为性质及所处的不同阶段。法律要件分类说是民事诉讼中对于证明责任分配的通说,基于行政诉讼与民事诉讼之间的共通性,在行政诉讼中确定证明责任分配时,也可将其基本原理引入行政法律关系中,为完善行政诉讼证明责任分配理论提供一条新思路。 Asopposed to'who advocates,who testifies',the distribution rule of the burden of proofincivil procedure,'liability of patto the proofopposite place'isapublicly-acknowledged fundament alprinciplein administrative law suit.However,the concrete setting of rules isnotequal to principles.The nature and different phases of different administrative actions must be taken intoaccount.The doctrine of classification ofl egalrequirement sisageneral description of distribution of burden of proofincivil procedure.Based on the commonality between administrative lawsuit and civilprocedure,when identifying the distribution of burden of proof,we can also fitits fund amental principlesin to administrative legalrelation.This will provide a new idea for the perfection of the theory of distribution of burden of proofin administrativel awsuit.
