摘　　要： 本文从"中国文艺类非物质文化遗产保护维权第一案"说起,分析备受社会关注的贵州安顺地戏维权、状告我国著名导演张艺谋一案,对原告一再败诉的原因进行法理剖析,探讨现有国内外相关法律法规可以提供的有限的法律支持。论文进一步从案件出发,结合田野调查资料,分析我国非物质文化遗产保护各环节存在的法律缺失,对非物质文化遗产法制建设提出一些建议。 This paper introduces the 'First Right-Safeguarding Case on the Chinese Intangible Cultural Heritage of Literature and Art' and,analyzes the socially concerned case,which was a lawsuit against the famous movie director Zhang Yimou,and the reason that why the plaintiff repeatedly lost the lawsuit,as well as explores the legal support which can be provided by Chinese and other countries 'relative laws and regulations.Based on the fieldwork,the paper also analyzes the legal flaws which exist in the links of Chinese intangible cultural heritage protection and,proposes several suggestions on the legal system construction of intangible cultural heritage.
