摘　　要： 社会公权即政府权力,是维护社会治安之必须,维护和谐社会之必须。无公权则无法协调社会秩序。但是公权与私权之间具有不平等性,享有对公民个人的支配权,并以国家强制力为后盾,公民相对于公权本来就为弱势群体,公民个人无法与之相抗衡,往往处于被动、服从的地位,极易受到侵害。如果公权被滥用,将对国家、集体和公民利益造成超乎任何犯罪的损失。因此,要控制行政权力膨胀,加强对行政权力的法律控制,以防止其滥用和越权行使以保障基本人权,防止权力异化损害人民民主权利。 The social public power that is governmental authority,it is necessary to maintain social order and construct the harmonious society.No public power,no social order.But there are inequality between civil right and public power,public power enjoy the domination of the right of individual citizens,and be backed up by the State,citizens was vulnerable groups,individual citizens can not counterbalance against governmental authority,so they are often in passive,subordinate status,vulnerable to be violated.If pub...
