摘　　要： 酷刑与人性有密切联系,是对人道的背弃。酷刑涉及刑事立法和刑事司法两个层面,涵盖了刑事实体法和刑事程序法两个领域。酷刑是对刑的道德或法律评价。中国的酷刑,历史久远,种类繁多,形成原因复杂。对酷刑的审视,有益于刑的人道化、轻缓化。 Though having a close relationship with human nature,brutal penalty has violated humanity in itself.It involves criminal legislation and justice and is certain moral or legal evaluation to criminal itself,covering criminal substantive law and criminal procedural law.With a long history and a great variety,China s brutal penalty has very complex formation roots.A careful examination of brutal penalty can humanize and relieve criminal.
