摘　　要： 农民工特指具有农村户口身份却在城镇务工的劳动者。目前,我国的社会保障法律制度还不完善,对农民工的社会保障立法目前主要还是依靠地方政府规章和规范性文件。立法工作滞后,立法空白多、位阶低、体制不规范、适用范围窄。其原因有三:一是城乡二元社会保障体系的限制;二是与社会保障体系相关制度的“约束”;三是观念障碍。 Peasant workers are those that they possess country registered permanent residence but come to city for work.At present,legislation on social security of peasant workers mostly depends on local governments' regulations and documents.The exposed problems on actual legislation are as follows,legislative tasks lags seriously,legislation has many blankness,legislation ranks low,legislation system isn't canonical,legislation has narrow applied scope,social security rules carry out badly,and so on.The reasons of the deficient legislation mostly come down to localization of Chinese duality social security system,restriction with concerned rules on social security,obstacles on people's concept.
