摘 要: 在颁行八年之后,《建筑法》与建筑市场管理、其他建设法规已不能很好地协调,存在诸如调整范围过于狭窄、工程保证担保规定缺乏、肢解分包规定不合理等问题。基于此,国家有关部门已启动《建筑法》的修订工作。本文分析了《建筑法》的不足,将修改内容分为全法的结构性修改和条文的根本性修改,并对于具体修改方案提出了建议。 Construction Law can not match the construction market administration because it has some defects after 8-year implementation, such as too limited applicable scope, lack of items of construction surety and bond, too simple items of profession permission and unreasonable items of disassembled subcontract.
